This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Kishannagar P.S. Case No.77 of 2021, corresponding to Spl. G.R. Case No.67 of 2021, pending in the file of learned A.D.J.-cum- Special Court under POCSO Act, Cuttack, for commission of alleged offences under Sections 376(3) of I.P.C. and Section 6 of POCSO Act. 3.

Heard learned counsel for both the parties. Perused the FIR, Case Diary, statement of witnesses and 164 statement of the victim girl.

Learned counsel for the Petitioner does not want to pres this bail application at this stage with liberty to move an application at a later stage with a prayer to direct the trial court to conclude the trial of the case at an early date.

Learned counsel for the State does not have any objection if a direction is given for expeditious disposal of the trial.

In view of the above submission, this Court disposes of the bail application with liberty to the trial court to conclude trial of the case within a period of four months hence. In the event trial of the case is not concluded within the specified time, it is open for the Petitioner to move fresh bail application, in such event, the trial court shall consider the same in accordance with law without being influenced by anything. 7.

With the above direction, the BLAPL is accordingly allowed.

Issue urgent certified copy of this order on proper application.
