This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.341 of 2022 pending in the file of learned S.D.J.M. Rayagada, arising out of Rayagada P.S. Case No.157 of 2022, offence under Sections 498A/302/304-B of IPC and Section 4 of the D.P. Act, 1961 and is in custody since 26.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District and Sessions Judge, Rayagada by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

Since, the consideration by the learned Court in seisin over the matter was during the course of investigation, this Court is not inclined to entertain this bail application at this stage.

The petitioner is at liberty to move the learned Court below after filing of charge sheet. The same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
