This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1130 of 2022 pending in the file of learned S.D.J.M. Bhanjanagar, Dist-Ganjam arising out of Tarasingi P.S. Case No.237 of 2022, under Sections 399/402 of IPC read with Section 27 of the Arms Act/Sec 4 and 5 E.S. Act and is in custody since 02.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Bhanjanagar by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the order of rejection.

Taking into account the nature of allegations and considering the submission of the learned counsel for the petitioner that the petitioner has no criminal antecedent and keeping in view
his age, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. While enlarging the petitioner on bail the learned court below shall verify assertion regarding his criminal proclivity. If it comes to the fore that the petitioner has any criminal antecedent this order shall stands recalled.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once in every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
