This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.911 of 2022 pending in the file of learned J.M.F.C. Rourkela arising out of Cyber PS, Rourkela P.S. Case No.7 of 2022, under Sections 419/420 and 406 of IPC and is in custody since 28.05.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Rourkela by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

The order of rejection reveals that in the meanwhile the informant and her son have been examined.

Considering the nature of allegations and examination of the materials witnesses, this Court is persuaded to direct release of

the petitioner. Learned Court in seisin over the matter to fix the terms so as to ensure the presence of the petitioner on each date of trial.

Additionally it is directed that one of the sureties shall be his immediate member of the family.

9.

It is further directed that the petitioner shall furnish cash security to the tune of Rs. 5,00,000/- (Rupees Five Lakhs Only) to be pledged in favour of the Court in seisin over the matter and the same shall be kept in kept in a short term interest bearing account which shall abide by the present of the case. 10.

Accordingly, the BLAPL stands disposed of.
