This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.541 of 2022 pending in the file of learned S.D.J.M. Bhawanipatna arising out of Bhawanipatna P.S. Case No.169 of 2022, under Sections 379/34 of IPC and is in custody since 04.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna by order dated 13.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the punishment prescribed and keeping in view the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account the criminal proclivity of the petitioner this Court directs that he shall be appear before the jurisdictional police station once every week till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
