Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) Direct the Opp. Parties to pay interest on such inordinate delay in disbursing the gratuity and leave encashment and retiral dues in terms of the principles decided by the Hon'ble Apex Court as well as this Hon'ble Court in the case of D.D. Tiwari (D) Thr. LRs-vrs. Utta Haryana Biji Vitaran Nigam Ltd., reported in 2015(I) OLR SC 81, Mohan Dakua & Others vrs. SAIL, reported in 2015(I) OLR 386, Nabaghan Rout and Others vrs. OLIC Ltd. & Others reported in 2015(I) ILR-CUT-1000 and thereby quashing the order dated 19.10.2020 vide Annexure-5 as it is illegal, arbitrary, unconstitutional and not in consonance with the Regulation 45(4) of Bank Regulation and Regulation 45,46 (1) (2)(3) of Pension Regulation of the Bank".

Learned counsel for the Petitioner submits that through highlighting his grievances, the Petitioner has filed a representation at Annexure-6 to the Writ Petition, before the opposite party No.1 but till date nothing has been
// 2 // done in the matter. In such background, he prays that a direction be issued to opposite party No.1 to take a decision on the above noted petition within a specific time period. 5.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.1 to take a decision on the above noted petition in accordance with law and also taking into account the order passed under Annexure-3 within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
