This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with G.R. Case No.2678 of 2022, pending in the file of learned S.D.J.M., Sambalpur, arising out of Sadar P.S. Case No.176 of 2022, for commission of offences under Sections 274/275/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sambalpur, by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner is in custody since 05.07.2022 and keeping in view the nature of allegations and the petitioner is stated to be the first offender and filing of charge-sheet as stated by the learned counsel for the petitioner, this Court directs

the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
