This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner is permitted to correct the cause title (name of the petitioner) in Court. 4.

The petitioner is an accused in C.T. Case No.346 of 2022 pending in the file of learned G.N.-cum-JMFC, Sukinda arising out of Kalinganagar P.S. Case No.170 of 2022, under Sections 420/468/471/120-B of IPC and is in custody since 08.08.2022. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Jajpur Road by order dated 19.08.2022 in the aforementioned case, the present BLAPL has been filed. 6.

the learned counsel for the petitioner submits that he is not a named accused and it is further submitted that one of the accused has been released on anticipatory bail in order dated 29.08.2022

ABLAPL No.10242 of 2022. Accordingly, prayer for release is made.

Taking into account the nature of the allegations the punishment prescribed and release of co-accused as above, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
