This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.55 of 2020 pending in the file of learned Additional District Judge-cum-Special Court under POCSO Act, Puri as T.R. Case No.74 of 2020 arising out of Pipili P.S. Case No.159 of 2020, under Sections 363/376 of IPC read with Section 6 of the POCSO Act and is in custody since 19.06.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Court under POCSO Act, Puri by order dated 24.06.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the 164 Cr.P.C. statement.

Learned counsel for the State on the basis of recitals in the Case Diary submits that the petitioner did not agree for medical examination.

Keeping in view that charge sheet has already been filed on 15.08.2022 and the petitioner is in custody since 19.06.2020, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter so as to ensure his presence on each date of trial.

Accordingly, the BLAPL stands disposed of.
