This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.9 of 2022 pending in the file of learned Senior Civil Judge-cum-ASJ (Women's Court), Bargarh arising out of Attabira P.S. Case No.312 of 2021, offence under Sections 294/376/506/450 of IPC. 4.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh by order dated 17.06.2022 in the aforementioned case, the present BLAPL has been filed.

Since trial has commenced, this Court is not inclined to entertain this bail application at this stage. 6.

Learned counsel for the petitioner on instructions submits that out of 25 cited witnesses, 23 have already been examined and the trial is lingering because of non-examination of the informant.

Considering such submission and the petitioner is in custody since 25.10.2021, learned Court in seisin over the matter is called upon to take steps for ensuring the presence of the informant. 8.

And, conclude the trial within a period of one month from the date of receipt/production of copy of this order. Failing which it shall be open to the petitioner to move the learned Court in seisin over the matter and same shall be considered on its own merits keeping in view the materials on record.

Accordingly, the BLAPL stands disposed of.
