The Petitioner, who is guarantor in a vehicle loan account availed by the Opposite Party No.2, has filed this writ petition challenging the notice under Section 13(2) of the SARFAESI Act, 2002 dated 7th October, 2016 (Annexure-1) issued by Opposite Party No.1-Bank.

At the time of hearing, Mr. Das, learned counsel for the Petitioner states that the present writ petition has become infructuous in view of the account having been closed based on amicable settlement.

In view of the above, this writ petition is dismissed as infructious.
