1. This matter is taken up through hybrid arrangement.

2. Heard.

3. The present petitioner has filed this Writ petition seeking permission to appear in the multiple choice questions for recruitment Test of Teachers of District Cadre for S.T. & S.C. Development Department Schools which is scheduled to be held on 28.08.2022.

4. The grievance of the petitioner is that though there is minimum 50% of aggregate marks appearing in the Row7 under Para-5(c) of S & ME Department Resolution No. 18618/SME dated 17.09.2016, the eligibility criteria for appearing the OSSTET Examination for PET candidates has been omitted there from vide Office Order No. 775 dated 12.01.2022 under Annexure-2 and also communicated to S.T./S.C. and minority Back Ward

// 2 // Development Department vide Office Order No. 775 dated 12.01.2022 for information. Hence, there is no minimum mark has been fixed for the PET teachers.

5. In view of the above it appears that the petitioner of the instant case has secured above 50% qualifying mark and she should have been permitted to appear the examination.

Accordingly, the Writ Petition is disposed of with a direction that the Opposite Party No. 2- The Collectorcum-Magistrate, Kandhamal shall allow the petitioner to appear for multiple choice questions for recruitment Test of Teachers of District Cadre for S.T. & S.C. Development Department Schools which is scheduled to be held on 28.08.2022.

7. Accordingly, this Writ Petition is disposed of.

8. Issue urgent certified copy as per Rules.

9. A free copy of the order be supplied to the learned counsel for the petitioner and for School and Mass Education Department information and necessary compliance.
