This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Khaparakhol P.S. Case No.95 of 2022 corresponding to G.R. Case No.507 of 2022, pending in the file of learned S.D.J.M., Patnagarh, for alleged commission of offences under Sections 274/275/120-B of IPC. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Patnagarh, by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner seeks bail inter alia on the ground that the basis of implication is on account of co-accused statement and since the petitioner is in custody from 03.08.2022 and the investigation having progressed substantially.

Learned counsel for the State opposes the prayer inter alia on the ground that the petitioner has criminal antecedents of similar nature.

Taking into account the nature of the allegations and the manner of accusation in the case at hand, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

It is directed that the petitioner shall appear before the jurisdictional police station once every week till submission of final form.

9.

Accordingly, the BLAPL stands disposed of.
