This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Jagatsinghpur P.S. Case No.25 of 2022 corresponding to Spl. G.R. Case No.25 of 2022, pending before the learned Additional District Judge-cum-Special Courts under POCSO Act, Jagatsinghpur, for alleged commission of offences under Sections 363/366/376(2)(n) of IPC read with Section 6 of POCSO Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Courts under POCSO Act, Jagatsinghpur, by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State has brought to the notice of the Court 164 Cr.P.C. statement of the victim.

Considering the tenor thereof and taking into account that the petitioner is in custody since 24.05.2022 and charge-sheet has already been file on 06.08.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
