Challenging the order dated 21st April, 2017 passed by the learned J.M.F.C., Khandapara in G.R. Case No.176 of 2015, arising out of Fategarh P.S. Cae No.83 of 2015 taking cognizance of the offences under Sections 498-A, 304-B, 306, 406/34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act and issuing N.B.W.(A) against the petitioner, the petitioner approached this Court under Section 482 of Cr.P.C. with a prayer to quash the same, so also the entire criminal proceeding, in the interest of justice. 2.

At the time of call, none appears for the Petitioner. On the earlier occasion, when the matter was taken up on 14th July, 2017, the same was adjourned at the best of the Petitioner to 11th August, 2017 and on that date also, the same prayer was made.

From the aforesaid, the conduct of the counsel for the Petitioner shows that the Petitioner is not interested to pursue the matter.

Hence, this CRLMC is dismissed for non-prosecution. 5.

A copy of this order be communicated by the Registry to the Court concerned forthwith.
