This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Bhawanipatna Sadar P.S. Case No.305 of 2021 corresponding to C.T. Case No.908/72 of 2021, pending in the Court of learned Special Judge-cum-District & Sessions Judge, Bhawanipatna, for alleged commission of offences under Section 366/376(2)(n) of IPC read with Section 6 of the POCSO Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Adhoc Additional District & Sessions Judge, (F.T.S.C.), Kalahandi, Bhawanipatna, by order dated 26.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioner produced the 164 Cr.P.C. statement.

Perused the same.

Taking into account the nature of allegations and filing of charge-sheet in the meanwhile as stated at the Bar, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
