This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

On instruction, Mr. D. Nayak, learned Addl. Government Advocate has stated that in absence of the regular Presiding Officer, the in-charge Presiding Officer is holding the courts on regular basis. But sometimes, the said court may not be available for a day or two. 3.

Mr. Nayak, learned Addl. Government Advocate has further stated that on 22.02.2023 the in-charge Presiding Officer will hold the court where the proceeding, pending before the Presiding Officer whose post is presently vacant, may be taken up. 4.

In view of the above statement, Mr. S. Pradhan, learned counsel appearing for the petitioner has submitted that he would withdraw this Interlocutory Application for modification of the order

dated 26.08.2022 in order to approach the Presiding Officer, incharge for the appropriate order. 5.

Accordingly, the Interlocutory Application stands disposed of as withdrawn.
