This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T. Spl. (POCSO) Case No.42 of 2022 arising out of Tomka P.S. Case No.46 of 2022, pending in the Court of learned Additional District & Sessions Judge -Cum- Special Court under Pocso Act, Jajpur, for alleged commission of offences under Section 363/366/376(2)(n)/109 of IPC read with Section 6 of the POCSO Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned, Additional District & Sessions Judge -Cum- Special Court under Pocso Act, Jajpur, by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is evident from the same that the petitioner is not the principal accused and the allegation is that he is the abettor.

Taking into account the nature of allegations and the period of custody since 19.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
