This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with C.T Case No.450 of 2022 pending in the court of learned S.D.J.M., Baripada, arising out of Baripada Sadar P.S. Case No.48 of 2022 for the alleged commission of offence under Sections 392/394/411 IPC and Section 25 of the Arms Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Baripada by order dtd.27.07.2022, the present BLAPL has been filed. 5.
It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since 25.03.2022 and as jewellary and cash involved in the crime have already been recovered from the co-accused and the implication of the Petitioner is on the basis of
the statement of the co-accused and the final form has already been submitted on 22.06.2022, his further continuance in custody is not warranted.

Learned counsel for the State opposes the prayer for bail, inter alia, on the ground that the Petitioner has criminal antecedent of similar nature.

Considering the period of custody of the Petitioner and the filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station of the Court in seisin over the matter once every week till conclusion of trial in view of the criminal antecedent.

The BLAPL thus stands disposed of.
