This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Salepur P.S. Case No.177 of 2021 corresponding to S.T. Case No.52 of 2021, pending in the Court of learned Additional Sessions Judge, Salipur, for alleged commission of offences under Sections 376(2)(n)/506 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Salipur, by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the assertion at the Bar that trial is not commenced, this Court is not inclined to consider this bail application at this stage, keeping in view the criminal proclivity of the petitioner.

Since the petitioner is stated to be in custody since 10.08.2021, learned Court in seisin over the matter shall do well to conclude the trial within a period of four months from the date of receipt/production of certified copy of this order, in the event trial is not concluded it shall be open to the petitioner to renew his prayer. 7.

Accordingly, the BLAPL stands disposed of.
