This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.419 of 2022, pending in the file of learned S.D.J.M., Udala, arising out of Khunta P.S. Case No.116 of 2022, for offences under Section 376(2)(n) of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional District & Sessions Judge, Baripada, by order dated 30.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

Considering the tenor thereof and taking into account that the petitioner is in custody since 13.05.2022 and filing of chargesheet on 08.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
