This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T Case No.352 of 2020 pending in the file of learned S.D.J.M., Balliguda, arising out of Balliguda P.S. Case No.141 of 2020, for offence under Sections 141/148/435/436/395/121-A/ IPC and Sections 25/27 of the Arms Act and Section 16/18/18-A/20/22 of the Unlawful Activities Act and Section 17 of the Criminal Law amendment Act and is in custody since 22.7.2022 .

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. District and Sessions Judge, Balliguda by order dated 19.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the generality of allegation and since the Petitioner is in custody since 22.-07.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Additionally, it is directed that before release of the Petitioner the Court in seisin over the matter shall verify the criminal proclivity of the Petitioner. If it comes to the fore that the Petitioner has any criminal antecedent this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
