This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in T.R. Case No.204 of 2022 pending in the file of learned Special Judge (POCSO)-cum-Addl. Sessions Judge, Bhubaneswar arising out of Tangi P.S. Case No.231 of 2022, for offence under Sections 344/363/366/376(2)(n) IPC and Section 6/12 of the POCSO Act and is in custody since 08.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge (POCSO)-cum-Addl. Sessions Judge, Bhubaneswar by order dated 03.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the statement of the victim recorded under Section 164 Cr.P.C.

Taking into account that the Petitioner is in custody since 08.07.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
