Heard Mr. S.Roy, learned counsel for Petitioner and Mr. R.N.Mishra, learned Addl. Government Advocate for the StateOpposite Parties. 3.
The present Writ Petition has been filed with the following prayer:- "(i) Why the action of the Opposite Parties in not extending the retiral benefits of the petitioner as due and admissible on the ground of nonfinalization of the proposal of Pay Protection / Fixation in the facts and circumstances of the case will not be declared as illegal; and (ii) Why the Opposite Parties will not be directed to sanction and disburse the retirement Gratuity, Final Pension, commuted Pension and Leave Salary as due and admissible in favour of the Petitioner forthwith; and (iii) Why the Opposite Parties will also not be directed to pay interest at the prevailing Bank interest on the Gratuity Amount as well as accumulated Pension Amount within a stipulated time".

He further submits that through highlighting his grievances, the petitioner has filed a representation on 15.09.2021 at Annexure-6 to the Writ Petition, before the opposite party No.1 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.1 to take a decision on the above noted petition within a specific time period. 5.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.1 to take a decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
