This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in Nayagarh P.S. Case No.80 of 2022 dated 28.05.2022 corresponding to G.R. Case No.345 of 2021, pending before the Court of the learned S.D.J.M., Nayagarh, for alleged commission of offences under Sections 457/380 of IPC. 4.

Being aggrieved by the Rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Nayagarh, by order dated 28.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the criminal proclivity of the petitioner No.1 as fairly submitted by the learned counsel for the petitioners, this Court is not inclined to entertain this bail application of the petitioner No.1 at this stage.

It shall be open to the petitioner No.1 to move at a later stage.

Taking into account the nature of allegations vis-a-vis the petitioner No.2, this Court directs the petitioner No.2 to be released on bail, on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
