This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in G.R. Case No.584 of 2021 arising out of Sohela P.S. Case No.207 of 2021, pending in the Court of learned J.M.F.C., Sohela, for alleged commission of offences under Sections 379/511/34 of IPC read with Section 15(2) of Petroleum and Mineral Pipeline Act, 1967.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Sohela, by order dated 17.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and considering that the petitioner is in custody since 26.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Considering the apprehension of the learned counsel for the State that the petitioner is a flight risk and he is likely to flee justice because of the criminal antecedents, this Court directs that one of the sureties shall be immediate family member and the other surety shall be a local person.

Additionally it is directed that the petitioner shall appear before the local police station once every month till conclusion of trial and certification of such appearance shall be submitted to the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
