2. Heard learned counsel for the Petitioner and Mr. Agasti Kanungo, learned CGA along with Mr. Biswajit Maharana learned C.G.C. appearing for the opposite parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "to direct the opp. parties to allow 3rd upgradation w.e.f 18.4.2005 under MACP scheme in favour of the deceased husband of the petitioner and further direction be issued for revision and re-fixation the pension and release the same with all the arrear benefits.

Taking into account the submissions made, the Petitioner is permitted to make fresh representation before Opp. party No.4 in that regard within a period of two weeks from today.

It is observed that if such representation is filed by the Petitioner ventilating her grievances, the same

// 2 // shall be considered by Opp. party No.4, taking into account the communication issued under Annexure-4, in accordance with law within a period of three months from the date of receipt of such representation. 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
