Though the matter is not listed today, on being mentioned by learned counsel for the petitioner, it is taken up on board by a separate notice.

This is an application for extension of time to surrender vis-avis order dated 7th September, 2022 passed in CRLMC No. 2325 of 2022.

By the above order dated 7th September, 2022, this Court had directed the petitioner to surrender before the learned court below in C.T. Case No. 92 of 2017 but he could not do so. Learned counsel for the petitioner submits that the time may be extended in order to enable the petitioner to surrender in compliance of the Court's order dated 7th September, 2022.

For the reason stated therein, I.A. stands allowed. 5.

Consequently, the petitioner is directed to surrender before the court of learned Sessions Judge-cum-Special Judge, Phulbani on or before 28th February, 2023 in connection with C.T. Case No. 92 of 2017 and in the event he surrenders, the court shall release him on bail with conditions as has already been directed by this Court while disposing of the CRLMC No. 2325 of 2022. 6.

Rest part of the order shall remain unaltered. 7.
