Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody in connection with Baipariguda P.S. Case No. 21 of 2021 corresponding to T.R. Case No. 07 of 2021 pending in the court of learned Sessions Judge-cum-Special Jude, Koraput-Jeypore for the alleged commission of offence under Sections 20(b)(ii)(C)/27 of the NDPS Act. 4.

It is alleged that the petitioner was transporting contraband ganja weighing 193 kgs when he was apprehended. His earlier application for bail was withdrawn granting him liberty to renew his prayer later. It is submitted that despite the fact that he has been in custody for more than one and half years the trial has not commenced as yet.

Taking into consideration the long period of dentition of the

petitioner in custody while not being inclined to grant regular bail to him, the bail application is disposed of with a direction to the court in seisin over the matter to release the petitioner on interim bail for a period of four months from the date of his actual release on such terms and conditions as he may deem fit and proper to impose including the condition that the petitioner shall appear on each date of posting of the case before the court below.

The BLAPL is accordingly disposed of.
