Heard Mr. P.R. Mishra, learned counsel for the petitioner and Mr. J. Patnaik, learned Government Advocate for the State. 3.

The petitioner has filed this writ petition seeking direction to opposite party no.2 to take a decision on the representation filed by the petitioner under Annexure-2.

This Court is not inclined to entertain such a prayer in this type of cases where encroachment case is pending before the authority. Since the encroachment case is pending before the authority, it is open to the petitioner to pursue his remedy before the said authority in accordance with law.
