This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Jeypore Sadar P.S. Case No.105 of 2022 corresponding to G.R. Case No.397 of 2022, pending in the Court of the learned S.D.J.M., Jaypore, for alleged commission of offences under Section 394 of IPC. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jeypore, by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by learned counsel for the petitioner that implication was on the basis of call detailed record (CDR) and he is in custody since 14.07.2022. Learned counsel for the petitioner further submits keeping in view the nature of allegations and

punishment prescribed, further continuance of the petitioner in custody is not warranted.

Taking into account the submission of learned counsel for the petitioner that he does not have any criminal antecedents as noted in the order of the learned Additional Sessions Judge, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till conclusion of investigation.

Accordingly, the BLAPL stands disposed of.
