This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with I.C.C. Case No.03 of 2022, pending in the court of learned N.G.N.-CumJ.M.F.C., Tangi, for commission of offences punishable under Sections 406/420/468/469/471/294/323/506/34 of I.P.C.

Considering the nature of allegations and gravity of offence and the facts of the case, I am not inclined to grant anticipatory bail to the petitioners. However, it is observed that, in the event the petitioner surrenders before the learned court in seisin over the matter within a period of three weeks from today, the petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem

// 2 // fit and proper, subject to condition that while on bail he shall cooperate with the investigation and shall appear before the I.O. as and when required by the I.O.

Accordingly, the ABLAPL is disposed of.
