Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed assailing the impugned order under Annexure-2 whereby the learned court below issued NBWA against the petitioner in connection with 1.C.C. Case No.3105 of 2010 pending in the file of learned J.M.F.C., Bhubaneswar on the grounds stated therein.

Perused the impugned order dated 22nd July, 2022 as at Annexure-3.

The learned counsel for the petitioner submits that the petitioner was on bail but on the date fixed, an application under Section 317 Cr.P.C. was rejected and thereafter, NBWA was issued against him and in facts and circumstances of the case, it is prayed that the petitioner should be directed to surrender and go on bail which the Court is inclined to.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned J.M.F.C., Bhubaneswar on or before 11th November, 2022 in 1.C.C. Case No.3105 of 2010 and in the event of his surrender, the court shall release him on bail with conditions as deem just and proper in the facts and circumstances of the case.

An urgent certified copy of this order be granted as per rules.
