This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.446 of 2022, pending in the file of learned J.M.F.C., Jatni, arising out of Valley P.S. Case No.141 of 2022, under Section 341/294/307/325/506/34 of IPC and is in custody since 08.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Khudra at Bhubaneswar by order dated 22.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that co-accused similarly placed have been released on bail by this Court by order dated 29.08.2022 in BLAPL Nos.7754 of 2022 and 7691 of 2022. Hence he seeks release of the petitioner.

Taking into account the release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
