Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.293 of 2022, pending in the file of learned J.M.F.C., Bhuban, arising out of Bhuban P.S. Case No.310 of 2022 under Sections 498A/294/323/307/506/34 of IPC and is in custody since 12.08.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Kamakhyanagar by order dated 22.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that the entire incident had happened in a sudden fit of anger and on

instructions states that the injuries suffered on the nose of the wife has been categorized as simple.

Taking into account the background in which the incident happened and the injuries suffered by the victim wife and the period of custody since 12.08.2022 and that the investigation has progressed substantially, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
