This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) Why the action of the then Management-inCharge in issuing the impugned advertisement dated 19.05.2017 under Annexure-3 to fill up the post of Secretary by way of direct recruitment in the facts and circumstances of the case will not be declared as illegal and as such liable to be set aside; and (ii) Why the action of the Opposite Party No.4 in proceeding with the selection vide Annexure-4 pursuant to the advertisement issued on 19.05.2017 under Annexure-3 in the facts and circumstances of the case will not be declared as illegal"

Learned counsel for the Petitioner submits that through highlighting his grievances, the petitioner has filed a representation on 15.02.2021 at Annexure-5 to the Writ Petition, before the opposite party No.2 but till date

// 2 // nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.2 to take a decision on the above noted petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.2 to take a decision on the above noted petition in accordance with law and also taking into account the rules framed on 07.02.2011 and the guidelines issued on 18.12.2003 as well as 24.09.2013 by the self-same Opposite Party No.2 within a period of one month from the date of receipt of this order. Till such a decision is taken, no further action be taken in terms of the advertisement issued on 19.05.2017 under Annexure-3.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
