This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

It is submitted by the learned counsel for the Petitioner that the Petitioner is an innocent person having no nexus with the alleged commission of offence. It is also submitted by the learned counsel for the Petitioner that the names of the Petitioner does not find place in the F.I.R. It is contended by the learned counsel for the Petitioner that the informant has foisted this case with false and concocted allegation against the Petitioner. Further, learned counsel for the petitioner submits that on similar footing with the present petitioner, other co-accused persons have already been released on bail by this Court in ABLAPL No.7726 of 2022 vide order dated 08.08.2022. 5.

Considering the nature of allegations made, gravity of the

// 2 // offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders and moves an application for bail before the learned S.D.J.M., Nayagarh in G.R.Case No.298 of 2022 arising out of Nayagarh P.S.Case No.65 of 2022 within a period of three weeks from today and move for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate and subject to verification of injury. 6.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
