This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.33 of 2021, pending in the file of learned J.M.F.C., Harabhanga, arising out of Purunakatak P.S. Case No.28 of 2021 under Sections 409/420/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Boudh by order dated 19.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the allegations are more or less based on documentary evidence, this Court is persuaded by the submission of the learned counsel for the petitioner that since he is

in custody since 17.07.2022, his further continuance is not warranted.

Keeping in view the nature of allegations and the punishment prescribed and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

8.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till the conclusion of investigation.

Accordingly, the BLAPL stands disposed of.
