This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Learned counsel for the Petitioner submits that the Petitioner is being summoned to the Police Station repeatedly and he is being harassed by the Police.

Learned Addl. Standing Counsel, on instruction over telephone, submits that there exists some business dispute for which the police is enquiring into the matter, but no F.I.R. has been registered in the present case till date.

Considering such submission, this Court is of the view that there is no apprehension of arrest of the Petitioner. Accordingly, the ABLAPL is disposed of with liberty to the Petitioner to approach this court in the event of any such apprehension of arrest arises. Further, it is open for the Petitioner to follow the mandatory procedure under Section 41-A, Cr.P.C., as has been directed by Hon'ble the Supreme

// 2 // Court in the case of Arnesh Kumar vs. State of Bihar and another, (2014) 8 SCC 273, if the same ratio is applicable to the present case. 5.
