This matter is taken up through video conferencing mode. 2.

Heard Mr. D.K. Panda, learned counsel for the petitioner. The petitioner files this writ petition to quash the order passed by the opposite party no.3 dated 09.02.2007 under Annexure-6, by which the resignation of the petitioner has been accepted and the petitioner further prays to direct the opposite party no.3 to grant the pension to him with effect from 20.04.1999.

If the petitioner's resignation has been accepted, the question of grant of pensionary benefit is not permissible, if he is not coming within the parameters of the rules to grant such benefit. 5.

Mr. D.K. Panda, learned counsel for the petitioner disputes such facts. Since the petitioner has disputed such facts, thereby this Court is not inclined to entertain the writ application. However, liberty is granted to the petitioner to pursue his remedy before the appropriate forum, if he is so advised.

With the aforesaid liberty, the writ petition stands disposed of. 7.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out

of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's Notice No. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
