This matter is taken up through hybrid mode.

On the oral prayer of learned counsel for the Petitioners, the matter was adjourned to be taken up after recess. When the matter was called after recess, none had appeared on behalf of the the parties to pursue the matter.

The CMP has been filed assailing the order dated 5th September, 2018 passed by learned Additional Civil Judge (Senior Division), Puri in C.S. No.199 of 2012, whereby an application under Order XXVI Rule 10-A C.P.C. filed by the Plaintiffs to send Ext.8 to the handwriting expert, has been rejected.

From the order sheet, it appears that notice was issued in the CMP on 13th December, 2018 and this Court, as an interim measure, directed that learned trial Court may hear the argument of the parties, but shall not pronounce the judgment till the next date. Thereafter, the matter was adjourned on several occasions extending the interim order.

None appears on behalf of the Petitioners to pursue the matter.

Accordingly, this CMP stands dismissed for nonprosecution. 7.

The interim order dated 13th December, 2018 passed in I.A. No.1547 of 2018 stands vacated.
