The matter is taken up through hybrid mode.

Heard Mr. B.K. Sahoo, learned counsel for the Petitioner and Mr. K.K. Das, learned Additional Standing Counsel. 3.
This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Prafulla Jena in connection with Khandagiri P.S. Case No.540 of 2019 corresponding to T.R. Case No.544 of 2019 pending in the court of learned Sessions Judge Khordha for alleged commission of offence under Section 20(b)(ii)(c) of NDPS Act for alleged possession of contraband ganja weighing 37 kg. 750 grams. 4.
It is submitted on behalf of the Petitioner that he is inside custody since 13th September, 2019 and in the meantime three witnesses have been examined in course of trial and their evidences do not support the prosecution case for alleged commission of the offence.

It reveals from record that earlier the Petitioner was released on interim bail.

Upon hearing Mr. Das, learned Additional Standing Counsel for the State and keeping in view the total quantity of contraband ganja and the embargo contained under Section 37(1)(b) of NDPS Act, I am not inclined to release the Petitioner on bail. Accordingly, his prayer for bail is rejected.

However, the learned trial court is directed to take steps for expeditious completion of trial.

The BLAPL is disposed of.
