This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner, learned counsel for the Informant and learned counsel for the State. 3.
The Petitioner is an accused in T.R Case No.40 of 2022 pending in the file of learned Addl. District & Sessions Judge-cumSpecial Court under POCSO Act, Rayagada, arising out of Tikiri P.S Case No.105 of 2022, for commission of offence under Sections 376(2)(n)/376(3)/323/506/307/34 IPC and Sections 4/6 of the POCSO Act and Section 4 of the D.P Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge-cum-Special Court under POCSO Act, Rayagada by order dated 22.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since 29.07.2022 and the charge sheet having been filed on 23.09.2022, further continuance of the Petitioner in custody is unwarranted.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Considering the tenor thereof and filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 8.
Accordingly, the BLAPL stands disposed of.
