This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in Titilagarh P.S. Case No.99 of 2020 corresponding to G.R. Case No.134 of 2020, pending in the Court of the learned S.D.J.M., Titilagarh, for alleged commission of offences under Sections 342/376(1)/294/506/114/34 of IPC. 4.

Being aggrieved by the Rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Titilagarh, by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the 164 Cr.P.C. statement of the victim, this Court is not inclined to entertain the bail application of the petitioner No.2, which stands rejected.

It shall be open to the petitioner No.2 to renew his prayer after examination of the victim.

Keeping in view the nature of allegation, this Court directs the petitioner No.1 to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
