This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in S.T. Case No.37 of 2022 (C.T. Case No.1196 of 2021) corresponding to Badmapahar P.S. Case No.140 of 2021, pending before the learned Additional District & Sessions Judge, Rairangpur, for alleged commission of offences under Sections 302/201 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Rairangpur, by order dated 05.08.2022 in the aforementioned case, the present BLAPL has been filed.

Since it is stated at the Bar that trial has already commenced in the meanwhile, this Court is not inclined to entertain the bail application of the petitioner.

It is submitted by the learned counsel for the petitioner that the entire accusation is based on circumstantial evidence and the petitioner who is in custody since 19.12.2021. 7.

Considering the same the learned Court is called upon to conclude the trial within a period of four months from the date of receipt/production of the copy of this order. 8.

In the event trial is not concluded, it shall be open to the petitioner to move this Court afresh.

Accordingly, the BLAPL stands disposed of.
