This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Talasara P.S. Case No.38 of 2022 corresponding to S.T. Case No.52 of 2022, pending in the Court of the learned District & Sessions Judge, Sundargarh, for alleged commission of offences under Sections 498-A/302 of IPC. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sundargarh, by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that though the accusation was under Section 498-A/302 of IPC, after investigation the charge-sheet has been filed under Section 306 of IPC.

Considering such submission and taking into account that the petitioner is in custody since 28.02.2022, this Court directs the

petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
