This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in 2(a)CC Case No.37 of 2022 (N) pending on the file of learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur, arising out of P.R No.114 of 2022-23, for commission of offence under Section 20(b)(ii)(C) of the N.D.P.S Act and is in custody since 06.05.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by Sessions Judge-cum-Special Judge, Ganjam, Berhampur, by order dated 19.05.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that since final P.R. has been submitted during pendency of the bail
application before this Court, he will renew his prayer before the learned Court in seisin over the matter.

Considering the same, this Court is not inclined to release the Petitioner on bail. It shall be open to the Petitioner to renew his prayer before the learned Court in seisin over the matter which shall be considered the same on its own merit without being influenced by the earlier rejection or the order passed by this Court. 7.
With the aforesaid order, this BLAPL stands disposed of. 8.
