This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Nimapara P.S. Case No.166 of 2022 corresponding to G.R. Case No.51 of 2022, pending in the Court of the learned Additional District Judge -cum- Special Court under POCSO Act, Puri, for alleged commission of offences under Sections 341/294/376(1)450/506 if IPC and Section 6 of POCSO Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge -cumSpecial Court under POCSO Act, Puri, by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the 164 Cr.P.C. statement of the victim and the medical examination report.

Taking into account that charge-sheet has already been filed in the meanwhile and that the petitioner is in custody since

17.05.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
