This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in G.R. Case No.1363 of 2022 arising out of Gosaninuagaon P.S. Case No.104 of 2022, pending in the Court of the learned S.D.J.M., Berhampur, for the alleged commission of offences under Section 52(a) of Excise Act. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Berhampur, by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into the submission of the learned counsel for the petitioner and considering the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
