This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.256 of 2022, pending in the file of learned Special Judge (POCSO)-cumAdditional Sessions Judge, Bhubaneswar, arising out of Bharatpur P.S.
Case No.263 of 2022, offence under Section 376(2)(n)/373/354-C/506 of IPC and under Section 6 of POCSO Act and is in custody since 29.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhubaneswar by order dated 17.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C statement of the victim. 6.
Considering the tenor thereof and taking into account the submission of learned counsel for the petitioner that preliminary
charge sheet has been filed on 26.08.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
